These 7-Day ROI Promise Terms (the “Offer”) govern participation in Insightful’s 7-Day ROI Promise. These Terms supplement and are incorporated into Insightful’s Terms of Service, Acceptable Use Policy, and Privacy Policy. In the event of any conflict, these Terms shall prevail solely with respect to the Offer.

1. Offer Overview

The 7-Day ROI Promise (the “Offer”) is a limited, conditional promotional program designed to demonstrate potential value from Insightful’s Services during a short evaluation period.

The Offer does not constitute a general guarantee or warranty of performance and is available only to eligible customers who meet the requirements set forth below.

2. Definition of ROI

For purposes of this Offer, “Return on Investment” or “ROI” means identified value during the seven (7)-day evaluation period, as determined by Insightful, in accordance with these Terms and in good faith, which is equal to the Customer’s first month subscription fee for Insightful.

ROI shall be determined based on one of the following predefined evaluation conditions (selected by Insightful):

  • workload rebalancing or productivity gains;
  • software or AI usage improvements;
  • focus time improvements; or
  • burnout prevention insights.

No alternative methodologies or interpretations of ROI shall apply.

3. Eligibility

Customer qualifies for the Offer only if, during the evaluation period, Customer:

  • maintains a minimum of ten (10) employees;
  • installs Insightful’s Agents on at least five (5) active user devices;
  • enables continuous tracking functionality, including click-level activity data; and
  • provides access to data reasonably necessary to evaluate the Offer.

Customer represents that it has all necessary rights and permissions to enable all of the above.

The Offer is intended solely for small and medium-sized businesses. Insightful may determine eligibility in its reasonable discretion and deny participation where criteria are not met.

4. Determination of ROI

At the end of the seven (7)-day evaluation period, Insightful will present a proposal of the ROI identified (or achieved), supported by evidence and based on one applicable evaluation condition.

Customer may accept or reject such proposal. Any rejection must be supported by reasonable, substantiated evidence sufficient to refute the proposal, and submitted within fourteen (14) days following the end of the evaluation period.

If Customer does not timely dispute the proposal, or fails to provide sufficient supporting evidence, the ROI shall be deemed achieved and the Offer fulfilled, with no further obligation on the part of Insightful.

5. Customer Responsibilities

Customer acknowledges that realization of ROI depends on proper implementation, cooperation, and accurate use of the Services.

Failure to follow implementation guidance, maintain required configurations, or provide accurate and complete information may result in disqualification from the Offer.

6. Exclusions

The Offer does not apply to:

  • competitors of Insightful;
  • customers providing false or misleading information;
  • use cases outside the defined evaluation conditions; or
  • any misuse, manipulation, or abuse of the Offer.

Insightful may disqualify any Customer under these conditions.

7. Service Credit; No Monetary Compensation

If Customer qualifies for the Offer and ROI is not identified, Customer’s sole and exclusive remedy is a service credit for thirty (30) days of complimentary access to Insightful’s Services, applicable only upon subscription to a paid plan, and Insightful shall have no further liability or obligation in connection with the Offer.

The service credit has no cash value, is non-transferable, and may not be exchanged for cash or any cash equivalent.

Customer acknowledges that participation in the Offer does not require any upfront payment and, to the fullest extent permitted by law, waives any claims for monetary damages, compensation, or reimbursement arising from or related to the Offer. 

8. General

These Terms are subject to Insightful’s Terms of Service, Acceptable Use Policy, and Privacy Policy.

Insightful reserves the right to modify or discontinue the Offer upon reasonable notice, provided that such changes shall not materially adversely affect Customer’s rights with respect to any ongoing evaluation period.
